Terms of Sale

Article 1 – Purpose

These terms of sale govern the sale of art photo prints by MrDéclenche. (Grégory Vautier, artist-author, SIRET 904 863 545 00052, Riom, Auvergne, France) through the website mrdeclenche.com.

Article 2 – Products

Each photograph is offered as a photo print, made to order by our printing partner WhiteWall, on Fuji Crystal Archive photo paper, matte (DP II) or metallic (Pearl). Prints are delivered on their own, without a frame. The available sizes and papers are specified on each product page. The watermark visible on the photos on the website does not appear on the print. The works are original creations by the artist.

Article 3 – Prices

Prices are set in euros. Depending on the delivery country, they may be displayed in the local currency, converted at the daily exchange rate. VAT not applicable, article 293 B of the French General Tax Code. Delivery costs are specified before the final confirmation of the order. For deliveries outside the European Union (Switzerland, United Kingdom, United States), any customs duties, import taxes and clearance fees, the amount of which cannot be calculated in advance, are not included in the price and are payable by the buyer.

Article 4 – Order and payment

The order is confirmed after full payment by bank card or any other means offered on the website. A confirmation is sent by email.

Article 5 – Production and delivery times

As each print is made to order, a production time is required before shipping. Indicative times are given when ordering (see our shipping policy). Prints are delivered in France, in the European Union, in Switzerland, in the United Kingdom and in the United States. Outside the European Union, customs formalities may extend the delivery time.

Article 6 – Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, you have 14 days from receipt of your print to exercise your right of withdrawal, without having to give a reason. Return costs are at your expense. The refund, including initial delivery costs (based on the standard delivery method), is made no later than 14 days after you have informed us of your decision; it may be withheld until the print is received or proof of its return is provided. The return conditions and the model withdrawal form are set out in our refund policy. You also benefit from the legal guarantee of conformity and the guarantee against hidden defects.

Article 7 – Intellectual property

All photographs presented remain the intellectual property of the artist. Any reproduction, distribution or commercial use without written permission is prohibited.

Article 8 – Complaints and disputes

Any complaint must be sent to mrdeclenche@gmail.com. Failing an amicable settlement, any dispute falls within the jurisdiction of the French courts.
